a)  This document sets out the privacy policy of Nannying Network Pty Ltd (ABN 67 690 702 473) (referred to in this privacy policy as ‘we’, ‘us’, or ‘our’).

b)  We are committed to protecting the privacy of personal information in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth) (Privacy Act), the Spam Act 2003 (Cth), and other applicable privacy laws. This Privacy Policy outlines how we collect, use, disclose, and manage personal information in the course of our operations.

c)  By providing personal information to us, you consent to our storage, maintenance, use and disclosing of personal information in accordance with this privacy policy.

d)  We may change this privacy policy from time to time by posting an updated copy on our Platform and we encourage you to check our Platform regularly to ensure that you are aware of our most current privacy policy.

2  TYPES OF PERSONAL INFORMATION WE COLLECT

2.1  We collect personal information from candidates, parents, and other third parties in connection with our Services. The personal information we collect may include the following:

(a) Contact details (e.g., name, suburb, email, phone number);   

(b)  A photo of your face, with no sunglasses or hats;

(c)   A photo of your family;

(d) Information regarding your children (e.g. age, allergies);

(e)   Historical information regarding your experience in childcare;

(f)   age;

(g)   date of birth;

(h)    IP-address;

(i)    credit card or other payment information;.

2.2  For Carers:

(a) Full name, date of birth, and contact details;

(b) Working with Children Check (WWCC) status and reference number;

(c) Employment history, qualifications, and references;

(d)  Professional certifications and training records;

(e) Health information where relevant to workplace safety;

2.3  For Parents and Childcare Centres:

(a)  Contact details and billing information;

(b)   Children's information including:

(i)    Age and developmental needs;

(ii)   Medical conditions and allergies;

(iii)  Emergency contacts;

(iv)   Special care requirements;

(v)  Service preferences and booking history

(c)  For Platform Users:

(i)   Device information and IP address;

(ii)  Browser type and settings;

(iii)  Platform usage patterns and preferences;

(iv)  Location data where permitted

(d)   For Platform Users:

(i)    We may collect information which may include criminal records, driving history, professional qualifications, certifications, and other background information as required by law or for assessing suitability.

2.4   Sensitive Information - we only collect sensitive information where:

(a)   You have provided explicit consent;

(b)   Collection is required by law;

(c)    Collection is necessary to prevent serious harm;

(d) Collection is necessary for establishment/defence of legal claims;

(e)   Sensitive Information may include:

(i)     Health information for children in care

(ii)     Medical certificates or incident reports

(iii)   Criminal history checks for Carers

3 HOW WE COLLECT PERSONAL INFORMATION

3.1 We may collect personal information either directly from you, or from third parties, including where you:

(a)  register for an account by filling in a relevant form;

(b) communicate with us via email, phone, or other channels;

(c) we may also collect personal information from third parties, such as:   

(i) publicly available sources (e.g., social media profiles).

(ii) we may use cookies and other tracking technologies to collect personal information when individuals interact with Platform. Individuals can control the use of cookies through their browser settings.

(d)   receive services from us;

(e)   submit any of our online sign up forms;

(f)   communicate with us via email, telephone, SMS, social applications (such as Instagram or Facebook) or otherwise;

(g) interact with our Platform, social applications, services, content and advertising.

3.2 We may also collect personal information from you when you use or access our Platform or our social media pages. This may be done through use of web analytics tools, ‘cookies’ or other similar tracking technologies that allow us to track and analyse your Platform usage. 4 WHY WE COLLECT, USE AND DISCLOSE PERSONAL INFORMATION

(b) communicating with Candidates and Parents about job opportunities;

(c)     improving and personalising our services;

(d)     complying with legal and regulatory obligations;

(e)     conducting market research and analysis;

(f)      responding to inquiries and complaints;

(g)     any other purposes disclosed at the time of collection or as permitted by law.

4.2    We may use Personal Information for direct marketing purposes, such as sending promotional materials or updates about our services, in compliance with the Spam Act 2003 (Cth). Individuals can opt-out of receiving direct marketing communications by following the instructions provided in the communication or by contacting us.

4.3  We use Personal Information to:

(a)      Facilitate matching between Carers and Parents or Childcare Centres

(b)      Process bookings and payments;

(c)      Verify identity and qualifications;

(d)      Provide customer support;

(e)      Meet regulatory obligations

4.4  Secondary purposes -  we may also use personal information for:

(a)      Service improvement and development;

(b)      Marketing communications (with consent);

(c)      Analytics and research;

In this regard, we may use email, SMS, social media or mail to send you direct marketing communications. You can opt out of receiving marketing materials from us by using the opt-out facility provided (e.g. an unsubscribe link);

(g) to send you administrative messages, reminders, notices, updates, security alerts, and other information requested by you; and

(h)  to consider a form that has been filled in by you.

5.2 We may disclose your personal information to cloud-providers, contractors and other third parties located inside or outside of Australia. If we do so, we will take reasonable steps to ensure that any overseas recipient deals with such personal information in a manner consistent with how we deal with it.

6.1 We take reasonable steps to ensure your personal information is secure and protected from misuse or unauthorised access. Our information technology systems are password protected, and we use a range of administrative and technical measures to protect these systems. However, we cannot guarantee the security of your personal information.

6.2 We are committed to keeping your personal information secure, and we will take all reasonable precautions to protect your personal information from unauthorised access, loss, misuse or alteration.

6.3  Your personal information may be stored in hard copy documents, or electronically on our software or systems.

6.4 We maintain up-to-date techniques and processes which meet current industry standards to protect your personal information both through physical security over its paper and electronic data stores, such as locks and security systems, and computer and network security systems with firewalls, encryption technology and passwords to control and restrict access to authorise staff for approved purposes.

6.5 We take reasonable steps to protect Personal Information from misuse, interference, loss, unauthorised access, modification, or disclosure. This includes implementing physical, technical, and administrative safeguards.

6.6 We retain Personal Information for as long as necessary to fulfill the purposes for which it was collected, or as required by law. Once Personal Information is no longer required, we will take reasonable steps to destroy or de-identify it securely.

6.7  However, no data transmission over the internet or electronic storage method can be guaranteed as completely secure. We cannot ensure or warrant the security of any information transmitted to us or stored on our systems.

7   SENSITIVE INFORMATION

7.1  We may collect sensitive information about you during the course of providing you services. The type of sensitive information we may collect includes: information relating to your child such as behavioural, learning, or developmental needs, or disabilities.

7.2 We will only collect this sensitive information where you consent and provide us with this information. If you consent, your sensitive information may only be used and disclosed for purposes relating to providing you with our services.

7.3 Your sensitive information may also be used or disclosed to comply with our legal obligations.

8  SECURITY

We take reasonable steps to ensure your personal information is secure and protected from misuse or unauthorised access. Our information technology systems are password protected, and we use a range of administrative and technical measures to protect these systems. However, we cannot guarantee the security of your personal information.

Our Platform may contain links to other Platforms. Those links are provided for convenience and may not remain current or be maintained. We are not responsible for the privacy practices of those linked Platforms and we suggest you review the privacy policies of those Platforms before using them.

10  REQUESTING ACCESS OR CORRECTING YOUR PERSONAL INFORMATION

10.1 If you wish to request access to the personal information we hold about you, please contact us using the contact details set out below including your name and contact details. We may need to verify your identity before providing you with your personal information. In some cases, we may be unable to provide you with access to all your personal information and where this occurs, we will explain why. We will deal with all requests for access to personal information within a reasonable timeframe.

10.2  If you think that any personal information we hold about you is inaccurate, please contact us using the contact details set out below and we will take reasonable steps to ensure that it is corrected.

10.3 All requests for access to your personal information must be made in writing and addressed to “the Privacy Officer” as outlined in our Contact Us section.

10.4 You must provide as much detail as possible regarding the business entity, department or person to whom you believe your personal information has been provided, and when. This will allow us to process your request faster.

10.5  We will acknowledge your request within 14 days, and access will usually be granted in useable format (Csv/Excel/API) within 30 days or otherwise within a reasonable period after the request is made. We will inform you if this timeframe is not achievable.

10.6  A fee may apply to such access in the event that a request for access is onerous or time consuming. Such a fee will cover staff costs involved in locating and collating information, and reproduction costs.

10.7 If the manner requested is not reasonable and/or practicable you may be forwarded the information by another means reasonable in the circumstances, for example by mail or email, or you may be required to personally inspect your records at the appropriate place.

10.8 In some circumstances, we may not be in a position to provide access. Such circumstances include where:

(a)  access would create a serious threat to safety;

(b)  providing access will have an unreasonable impact upon the privacy of other individuals;

(c)  denying access is required or authorised by law;

(d)  the request is frivolous or vexatious;

(e)  legal proceedings are underway or otherwise anticipated;

(f)   negotiations may be prejudiced by such access; or

(g)  access would reveal a commercially sensitive decision making process.
